Terms of Service — Madrese Rabete

Acceptance of these terms

This text constitutes the terms of a legally binding agreement that sets out and governs the conditions for users' access to and use of the “Madrese Rabete” platform. Accordingly, when you click or check the box accepting these terms on our website, our user panel, or any of our other surfaces, or take any action equivalent to this based on the device you are using to connect with us, it means you agree to all the terms of use set out in this agreement, including all subsequent amendments, which you are also legally bound to comply with. You further agree that services will be provided to you on this basis.
“User” means any individual who accesses, in any manner and remotely, the services available on and through the “Madrese Rabete” platform, whether as a registered member, a visitor, or a client.
By merely using the “Madrese Rabete” services, you are deemed to have agreed to these terms and to all future amendments. If at any time and for any reason you disagree with any or all of these terms, you must immediately discontinue accessing and using the services. This applies to all services without exception.
We may amend these terms at any time. The date of the most recent update appears at the top of this page, and it is your responsibility to review any changes before each use. Continued use of the services means you accept the latest version of these terms with all of its amendments.

Who we are and what we do

“Madrese Rabete” is an information technology platform comprising a website, a user panel, content, and services, allowing remote access to mental health and relationship education services. These services are provided in situations where the provider and the recipient are not physically present in the same place at the time of delivery, and instead connect online or asynchronously.
We are not independently the producers or providers of mental health services. We merely provide a platform to facilitate connections between providers and recipients of these services on the terms set out in this agreement.
Remote services may be provided by any possible method, including text, audio, or video.
In addition to counseling sessions, our platform includes a library, a podcast, events, and the “هم‌دل” community. Each of these is subject to its own specific rules, set out in the clauses below, in addition to the general provisions of this agreement.

Eligibility for an account

The “Madrese Rabete” platform is not intended for individuals under the age of 18. By creating an account you confirm that you are at least 18 years old.
From the perspective of “Madrese Rabete”, a user is a person who, under the laws of their place of residence, has the ability, authority, and permission to independently access the services, agree to the terms of this agreement, and pay the fees, meaning there are no age, physical, or legal restrictions preventing them from using the services independently. If for any reason you do not meet some or all of the conditions in this clause, you must immediately cease using the services. No claim contrary to the provisions of this clause may be made or proven against “Madrese Rabete” or any of its affiliated persons, in particular its directors, employees, and providers, and you knowingly accept this.
You warrant that you will use our platform only and exclusively for yourself and no other person, and solely for your personal, non-commercial use.
The information you provide at registration or when completing your profile must be accurate, complete, and current. Keeping it up to date, in particular your email address, is your responsibility.
You must not share your account username and password with anyone. You are responsible for all activity conducted under your account.
An account belongs to one person. Creating multiple accounts for one individual, or giving your account to someone else, is a breach of these terms.

Providers and their relationship with “Madrese Rabete”

Mental health service providers are independent professionals who have chosen to use our platform as a medium for delivering their services. They are not our employees, agents, or representatives, and they do not act on our behalf. The relationship between you and a provider is strictly one of provider and recipient, to which we are not a party.
The “Madrese Rabete” platform hosts providers residing in and governed by various jurisdictions. While we conduct an initial review of a provider's qualifications at the time of onboarding, we do not warrant or guarantee that any given provider is fully authorized to offer services independently or under the supervision of another professional, as required by the laws of their jurisdiction. As we do not verify or investigate your place of residence, the basis for determining a provider's eligibility is their own jurisdiction of residence. If this criterion is unsuitable for you due to personal judgment or the legal requirements of your place of residence, you are required to immediately cease using the services.
For the purposes of this platform, we consider providers authorized to provide remote services if they are permitted to provide the same services in person within their jurisdiction of residence. We do not require additional licenses, permits, or legal reviews beyond this determination.
You acknowledge and agree that we exercise no control over the services rendered by providers and cannot assume any liability or responsibility for their conduct or the quality of their services. Providers bear sole and independent responsibility for the services they offer, including but not limited to compliance with professional standards, confidentiality obligations, record-keeping practices, and other ethical or legal duties applicable to their profession.
Our role is strictly limited to facilitating connections between you and providers. Any decision regarding the selection of a provider, the reasons for choosing them, the duration and manner of service delivery, the applicable fees, and the quality of the services provided is made entirely at your discretion, without any involvement or control from us.
Any description, document, résumé, or other information relating to providers that you access through our platform is provided solely by the providers themselves. The inclusion of such information does not constitute an endorsement, certification, or representation of its accuracy or reliability by us.
Your provider may determine that our services are not suitable for some or all of your needs, or that they are not authorized to provide the services you need, and may decide to discontinue offering services to you. Providers also have the discretion to discontinue their services to you at any time and for any reason.
Both you and we acknowledge and agree that no specific outcome can be guaranteed in the provision of mental health services. It is therefore possible that use of the services provided through our platform may not achieve all or part of the results you were seeking.

Non-emergency services

The “Madrese Rabete” platform is designed exclusively to facilitate the provision of non-urgent, non-emergency, and non-critical mental health services remotely. By accessing the platform and using the services provided on it, you represent and warrant that you are not experiencing any urgent, emergency, or crisis situation requiring immediate intervention.
You acknowledge, and we reiterate, that our services are not a substitute for urgent care, crisis intervention, or emergency medical services. As we are not equipped to assess whether you are experiencing an urgent mental health or medical condition, by accessing and using our services you explicitly represent and warrant that you are not in need of urgent care, crisis intervention, or emergency medical assistance.
If you believe or suspect that you are at risk of any thoughts or tendencies of suicide, self-harm, harm to others, or homicide, or you are aware of such a situation in someone else, you must contact emergency services or the police. In Canada, 911 is available for emergencies and the 988 helpline for suicide crisis. Because “Madrese Rabete” does not have access to the content exchanged between you and a provider, even if it were disclosed under exceptional circumstances, we cannot guarantee or interpret its meaning, context, or accuracy.

Inherent limits of remote services

Like any other telehealth service, the services provided on this platform may involve potential errors and risks, such as communication issues that may lead to misunderstandings or incorrect interpretations of the subject matter. You must therefore take the necessary precautions and, if in doubt, verify the accuracy of what you intend to do or not do through another reliable method.
Providers are not authorized to prescribe certain types of medication, including narcotics, controlled substances, non-therapeutic drugs, and other medications that may be harmful due to their potential for misuse. They may recommend over-the-counter medications or refer you to a physician for a prescription. You are responsible for making decisions regarding all of these matters, and there is no obligation.

Booking, payment, and invoices

All amounts on the platform are stated and charged in Canadian dollars (CAD) unless the page states otherwise. Currency conversion costs and any fees applied by your bank or card issuer are your responsibility.
Payments are processed by our payment provider, Stripe. Your card details are processed directly by that provider and are never stored on our servers.
Some services, including paid event registrations and counseling sessions, are billed by invoice. An invoice may be payable in full or in installments and carries a due date. Until an invoice is settled, the related service is not confirmed.
Promotional codes apply only to the invoice they were issued for and only within that code's stated limits, such as its validity period, usage cap, or minimum amount. We may void a code that has been misused, redistributed, or issued in error.
We inform you, and you accept, that our services are not covered by your place of residence's insurance, and that you must pay all costs yourself without seeking reimbursement from your insurer.
“Madrese Rabete” and providers are authorized to discontinue all or some of their services to all or some individuals at any time and under any circumstance, without prior action or notice. In such a case, “Madrese Rabete” is only obligated to refund any pre-paid amounts for services not yet delivered, provided that you notify us, via the email address you registered with, of a refund method feasible for us. We therefore state explicitly that we cannot commit to completing your course of counseling. This means we may be unable, for any reason, to finish it or to provide the number of sessions you wanted, and we will have no responsibility or obligation to compensate for any loss in this regard.

Events

Events may be online or in person, free or paid, and may have limited capacity. A registration is confirmed only once you have received confirmation of it and, for a paid event, the related invoice has been settled.
Registration for some events is subject to our review and approval and may involve a few questions. Accepting or declining a registration request is at our discretion and requires no statement of reasons.
The join link for an online event is personal and non-transferable. Sharing it with others is a breach of these terms and may result in your registration being cancelled.
We may need to reschedule or cancel an event. If we cancel an event, the amount you paid for that event will be refunded, and this is our only obligation in such a case.
Recording, republishing, or broadcasting event content in any form and for any purpose is prohibited without our prior written permission.

Library

Library membership is free and may require answering a few short questions. Those answers are used to personalize recommendations.
Book listings, summaries, and recommendations are informational and educational. They are not therapeutic advice, a diagnosis, or a substitute for counseling.
Any review or rating you submit must reflect your own genuine experience. We may remove a review that is abusive, promotional, fabricated, or otherwise in breach of these terms.

“هم‌دل” and the content you publish

“هم‌دل” is a space for members to share experience. Posts submitted by members are reviewed before publication and may be approved, rejected, returned for changes, or removed after publication. Publication decisions are at our discretion.
You are fully responsible for any content you publish, including posts, comments, reviews, and podcast comments.
The following is prohibited: identifying or contact information about other people without their consent, insults, threats, harassment, hate speech, obscene material, advertising of goods or services, pyramid schemes and network marketing, claims of cure or drug prescriptions, content that infringes the rights of others, and any content that violates applicable law.
By publishing content on the platform you grant us a worldwide, non-exclusive, royalty-free, transferable license to host, display, reproduce, and format that content in connection with providing and promoting the platform's services. You retain ownership of your content.
Content published by members reflects the view of its author, not the view, endorsement, or advice of “Madrese Rabete”. Any reliance on it is at your own risk.
We may remove or withdraw any content without prior notice and, on repeated breaches, restrict or block the account's access.

How we communicate with you

We reserve the right to communicate with you via the email address you provided at registration and to send you correspondence. You agree to review such correspondence and take any necessary action. We rely exclusively on this method for identity verification, and your confirmation of the email at registration assures us that the address belongs to you and is accessible to you. Sending an email constitutes notice, and failure to view, read, or act on an email, or a change to your email address without prior written notification to us, does not impose any liability on us.
Our emails fall into two categories: essential service messages (such as account verification, invoices, registration confirmations, and session or event reminders) and promotional messages (such as event invitations). Unsubscribing affects only the second category; essential service messages are sent for as long as you hold an active account.
You must not contact providers in any way other than through the “Madrese Rabete” platform, as “Madrese Rabete” cannot control interactions that take place outside the platform, unless we have expressly approved them.
The only approved method for contacting us outside the platform is support@madreserabete.com. Any correspondence outside this address is not approved by us. This includes communication through “Madrese Rabete” accounts on social networks such as Instagram and WhatsApp. Those accounts are managed by non-specialists and are neither designated nor supported for reporting problems or serious issues such as urgent, critical, or emergency conditions. You acknowledge that any statement made on those pages or accounts may be ignored by “Madrese Rabete”, and you have no right to raise any complaint, claim, or grievance in this regard.

Security, confidentiality, and recording

You are responsible for maintaining the security of your own information. We safeguard only the information held on devices under our control. Ensuring the security of the communication between you and us, given the device and platform you are using, and the security of the location from which you are communicating so as to prevent unauthorized recording of your voice or image, is your responsibility.
You are not permitted to record or store any audio or video of the communication unless you have previously informed us in writing and both we and the provider have consented to it.
How we collect and process your personal information is explained in our Privacy Policy, which forms an integral part of this agreement.

Intellectual property

All content and rights on the “Madrese Rabete” platform and website belong to “Madrese Rabete” and will remain its property. Neither these terms nor your use of the platform grants you any right to use or reference the brand elements, company name, logo, product or service names, trademarks, or service marks. You are not permitted to copy, reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any content.
You are not permitted to use the name or mark “Madrese Rabete”, whether registered or not, for yourself or others, altered or unaltered, or to use, disclose, or transfer any material produced or provided under that name or used on the platform, including programs and policies, for yourself or others.
None of the information or material available on the platform or on our pages in social media constitutes a recommendation, treatment, diagnosis, or endorsement of the safety or appropriateness of any drug or particular treatment. The content is solely for informational purposes. It is your responsibility to investigate and evaluate any content carefully, and you accept that any reliance on the content is at your own risk. We also emphasize that the material on the platform may contain technical, typographical, or photographic errors, and we do not guarantee that any of the material provided is accurate or current.

Prohibited conduct

Decompiling, reverse-engineering, or disassembling the platform, and creating or operating any program or script intended to index, examine, or data-mine any part of the platform, or to create a load on or interfere with the performance of any aspect of it, is strictly prohibited.
Attempting to gain unauthorized access to any aspect of the platform, its associated systems, or networks, causing harm to them, impersonating any person or entity, misrepresenting yourself, and using the platform in any way that violates any law, is prohibited.
You must refrain from using offensive language or engaging in inappropriate behaviour when communicating with anyone through the platform, including providers.

Services provided “as is”

You accept the “Madrese Rabete” platform as it is and as presented. We therefore provide no guarantees or assurances regarding specific conditions or situations, including but not limited to guarantees of reliability, timeliness, quality, suitability, or availability of the requested services. We do not guarantee the quality, suitability, or safety of services, and you agree to personally assume all risks arising from your use of the platform, whatever they may be. You are solely responsible for ensuring that our platform, our services, and anything related to us comply with any legal regulations and laws applicable to you. We bear no responsibility in this regard, and you acknowledge and accept this.

Limitation of liability

You acknowledge and agree that “Madrese Rabete”, for the purposes of this clause, includes its directors, employees, shareholders, affiliates, agents, service providers, and third-party independent contractors, and that none of them bears any liability for any loss, damage, or harm, whether foreseeable or not. This includes any loss, damage, or harm resulting from your use of or reliance on the platform or services, your inability to access or use them, any delay in doing so, or any interaction or relationship between you and any provider.
“Madrese Rabete” is not responsible for any information stored or recorded on any computer, tablet, mobile device, or any network, whether public or private, that you use to access the platform or services.
Without limiting the generality of the preceding clauses, under no circumstances shall “Madrese Rabete” be liable for any indirect, incidental, special, rare, exemplary, punitive, or consequential damages, including but not limited to professional negligence, personal injury, lost income, or lost data, arising from or related to any use of the platform or the services provided by providers. We have no obligation to compensate for any such damages, and you acknowledge and agree to this.

Indemnification

You agree to fully indemnify “Madrese Rabete”, including its directors, employees, shareholders, affiliates, agents, service providers, and third-party independent contractors, for any loss, damage, or harm incurred, including any claims, demands, losses, liabilities, and costs (including reasonable legal fees) arising from or related to your use of the platform and services, any breach or violation of these terms, or violation of the rights of any third party, including providers, other users, any person for whom you request services, or friends referred by you.

Suspension and termination of access

If you breach these terms, or engage in conduct that in our judgment threatens the safety of other users or the integrity of the platform, we may restrict, suspend, or block your access without prior notice.
You may request deletion of your account at any time. Deleting an account does not extinguish outstanding financial obligations, nor does it prevent us from retaining information we are required to keep by law or to defend our legal rights. Details are in our Privacy Policy.

Final provisions

These terms, including their latest amendments, replace all previous agreements or obligations.
These terms shall be governed by and interpreted in accordance with the federal laws of Canada.
These terms are not assignable or transferable by you without prior written consent from “Madrese Rabete”, but “Madrese Rabete” reserves the right to assign, transfer, or delegate any of its rights and obligations without your consent.
If any provision of these terms is deemed invalid, void, or unenforceable, that provision (or the part of it that renders it invalid, void, or unenforceable) shall be severed, and the remaining provisions shall continue in full force and effect.
